Nah, eyewitness testimony has been shown to be unreliable.

As unfortunate as that is in this case, it's very true. I have no doubt that Cork's recollection is spot on, but there have been countless individuals locked up for crimes they didn't commit due to inaccurate eye-witness reports. Our brains, in general, are pretty weak when it comes to remembering details - especially over a period of time.

I recall doing a case study a few years ago about a man who was wrongfully convicted of rape - because the victim identified him in multiple lineups. Turns out, DNA evidence later linked the crime to another individual and exonerated the man who had been in jail for 30 years. In this particular case, the woman was even having nightmares of the wrong person because of the photos she had picked out of a lineup, and police said "you picked the right one." Her brain had re-created a false memory based on information that was completely fabricated.

Scary shite.

What really gets me is that the jurors admitted they didn't believe his alibi, and therefore should have came back with a verdict of guilty. During jury selection, I think about half said that they would be reluctant to give someone a life sentence.

So this is the POS that shot you on trial? I understand about eyewitness testimony and all but you're saying this is the turd who shot you, why would they not believe you? Is there anything physical actually tying him to being in the house? Also, sounds like jury selection fricked you. I've been watching this OJ show on FX and it just makes me shake my head at what a joke our justice system is.

What about my life sentence? What about Chad's family's life sentence?

Hopefully you're seeing a therapist and have a good group around you. First, your life sentence is alive and you owe it to your friend and yourself to live through this and be stronger. Don't let those scumbags ruin any more lives. Your family and your friends family would be devastated if you did anything like you're talking. Take your Xanax when needed, don't abuse. If you're not health, get there. Go to the gym if you're not already.

The piece of shite "mother-in-law" who provided the so-called alibi should be arrested and indicted for perjury.

Absolutely. Once the POS is convicted, can someone press charges against that bitch?

Hang in there.

You are getting justice for your friend, as slow as it might be.

I have a friend who was murdered here in BR in 2013. There are no leads, no suspects. Case is getting colder by the minute and I don't think it will ever be solved. I want there to be a trial to hold the person(s) responsible.

They found both weapons, my phone that was stolen - which was used by his girlfriend, the "mother-in-law's" daughter - among other physical evidence.

ETA: in their house.

Cork, I'm an old poster so I've "known" you since before this all happened.

Keep fighting my man. And as a former addict, try and keep the xanax to a minimum. I'm sure you're getting therapy. Think about an anti depressant.

DO NOT LET THESE ASSHOLES WIN! AND REMEMBER THAT PEOPLE LIKE ME ARE WITH YOU. You are not alone.

How soon after the crime was the physical evidence found? It would be awfully convenient for the daughter and boyfriend to have been at mother-in-law's home during the time of the crime, 1:00AM, and then departed together to go to boyfriend's house with time for daughter to use stolen cell phone.

Wouldn't daughter and boyfriend have been questioned by police upon being found with physical evidence? Did they provide any statements that were inconsistent with mother-in-law's testimony, or was there a lack of corroborating claims? It just seems it would not be difficult to impeach the mother-in-law's testimony.

Amen. It's a shame we have so much difficulty taking out garbage like that and putting it in a landfill somewhere.

Fertilizer is all they're good for.

Stay strong. A hung jury beats the shite out of a not guilty. Good luck and thanks for the updates even though I can imagine that this is painful to go through.
