There is plenty of information to look up if it's that big of a concern or question there is law written on the matter and prior cases.

May have at one time, but not the case with the enforcement officers I have spoke to recently.

Not really accurate everywhere. In the costal zone, basically below Hwy 90 across the state, a permit is 100% a requirement to do this activity.
