i could see the argument if this was a burglary (ie, breaking into a place to steal stuff without any threats), but the perp was threatening physical force with what appeared to be a deadly weapon. as a society, you can't just let that slide, and if you do attempt to use physical threats/force, then you should expect to have a response

Can you still be charged with armed robbery if you use a fake gun? Seems like intent of the gun would trump it being fake.
