Also many instances of cell phone theft at school. Usually when this occurred the kid whose phone was lifted would go nuts disrupting the entire class.

I teach in a public high school and confiscating phones can cause huge problems. Who knows what is on those phones and some kids will rather a huge problem with teachers, administrators, and LEOs than to hand the phone over.
In my experience having the kids who get caught using the phone during class either put it in their backpack or a box removes the distraction and the kids don't feel they are at risk for the teacher to go through the phone.
And yes I have teacher friends who have taken phones and then lost them.
I suspect the owner of the phone took the phone when the teacher was not looking then demanded their phone back.
