Assume hypothetically that they were both drunk, he asked and she said yes, but, of course, in here diminished state of capacity, didn't really think it through. Neither did he. Why is he the offender here? Or what if she was the one who asked? What if he didn't want it and she pressured him into it and he, being of diminished capacity, agreed to it? She admits she has no idea how it happened. How does she know that's not what happened? Why couldn't he be just as much a victim as she claims to be? I think this is bullshite. The victim mentality is just out of control.

I don't buy the "put herself in that position" argument to justify sexual assault. I think if you take advantage of anyone, male or female, when they are in a state of diminished capacity, you are guilty of some sort of offense (although depending on circumstances I wouldn't call it rape). But, when the offender and "victim" are in the same condition, why is the guy automatically the wrongdoer?
