Deep Ellum Brewing suing TABC

Currently, wineries, distilleries, and even brewpub restaurants can legally sell their wares for off-premise consumption.


Good for them. Hope they are successful.

damn fools

guys in Austin have the right idea to take the fine and make TABC take them to court

now deep ellum has to prove that it is legal as opposed to TABC proving that it is illegal

Why does the TABC need to take them to court? Can't they just say 'frick you' and suspend their license?

Deep Ellum is taking the same route that Jester King took with TABC labeling restrictions. In the end that worked out pretty well, won one and loss one, and helped pave the way for a lot of the changes made to Texas beer laws in the following legislative session.

plus, they can still crowler from the brewery since they have the brewpub license.

i am guessing, based on the assumption that the establishment has consulted with lawyers prior to announcing this move, that TABC can only fine them for this stunt and not pull the license.

what brewery is currently selling directly to its customers without having a brewpub license?
