AT&T threatening to reduce data speed, is this legal?

ATT Free Msg: Your data usage this month has reached 3.75GB. If you exceed 5GB before your next cycle on 08/18/2015, you can still use unlimited data but your speeds may be reduced at times and in areas with network congestion. Wi-Fi helps avoid reduced speeds. Visit att.com/datainfo for more info.
I thought this was against the law? I pay for unlimited data so there shouldn't be any consequences for using as much as I want

That is a really low threshold but unfortunately I think it is legal.

wrong. they do this to discourage you from using so much

You should read your terms and conditions that you agreed to.

Something seems to be up this month with ATT. I haven't gotten that text in over 3 years and my brother has never gotten it and we both got it last week. Think they are appealing the FCC ruling now that was fining them 100 million or something like that for slowing speeds to a crawl

Yeah, i've gotten it twice in the past two weeks and don't remember ever getting it before
Maybe sending out the texts is a new thing. I don't understand it though, because I'm almost always on wifi

I was grandfathered in under the old unlimited data and they never presented me with any new "terms" before throttling my speed.

It's been at least four years since they started doing this

I was getting this repeatedly. I finally stopped clinging to "unlimited" (since it's not really unlimited) and got a plan with 10 gb. It's cheaper, and I get more data.

I got one of these texts a few years ago and then nothing for years until receiving one each of the last two months.
It's just a ploy to try and get people to use less data. It's a bluff. They won't actually throttle you.

They already started slowing data speed my friend!

I hadn't gotten the text in years either, then got it again last month and this month. I know I went over and didn't notice a slow down

If you didn't have unlimited, I wonder if they'd still slow your speeds to discourage use after you exceeded your limit
