First of all, I'm gonna need more background here. What happened beforehand?
Secondly, why don't people just listen? They had to tell him 3 or 4 times to keep his hands up. He absolutely didn't deserve to be shot (at least from what the video shows), but what was he trying to accomplish by continually putting his hands down?

The bottom line. The penalty for not listening is not death. The penalty for calling a cop a dick is not death. I can't imagine what could have happened beforehand that could change how the shooting was not justified. It can only provide blathering points to try to put the cops in a good light.
