You know what would be an even better use of public funds? Placing a cop outside of bars and watching for obviously drunk patrons getting behind the wheel as they leave, stopping them, and calling them a cab. You know they could actually protect and serve the public at the exact same time. But that doesn't generate money for municipalities like catching someone driving with a .08 BAC, so it will never happen.

Some states allow them to bust your for DUI based on your "intent" to drive.
I had a friend in Alaska go out to his buddy's car to get something out of it. His buddy was the designated driver and had given him the keys to open the car. Friend made the error of opening the driver's side door to get what he needed out of the console. Cop busted him and it stuck in court.
Another case to illustrate how retarded it is.
When I was stationed at Fort Knox, a Captain went to watch the Bengals. When the game was over, he realized he'd had too much to drink so rather than drive, he decided to sleep it off. It was cold, so he got in the car, turned on the heat and fell asleep.
Cop showed up to his window, blammo, that Captain got a DUI cause apparently, being behind the wheel is all it takes. I guess they should rename it cause "DRIVING" under the influence isn't apparently required.
