Because you know it's a fake gun. The caller said it's probably a fake gun. You know he was probably hiding it. But if the cop drove their thinking kid with fake gun and in the last second they see kid approaching the vehicle reaching at his waistband, errors in judgement could easily occur. This is a serious error in judgement though. They should have approached him like he was dangerous and at a distance. Kid wasn't even given a command to freeze or to get down on the ground. This one won't be easy and personally, I have no idea what the punishment should be.

It was stated in the article that the dispatcher didn't tell the officers the gun was fake.

OK. For starters, I wouldn't have pulled up RIGHT NEXT TO someone suspected of having a gun. The cops pretty much made this situation unavoidable.

Seriously? Easy for you to second guess the cop knowing its a fake gun now. The cop was dispatched to a kid in the park pulling a gun on people. You're also assuming the cops knew exactly where the kid was at. They may have just known park and pulled in right there.
To this officer he was looking into a complaint of aggravated assault with a firearm and when he exited his vehicle he was being approached by a teen pulling a gun from his waist band.
Its sad and horrible but I cant fault the officer

This. I'm sure it wasn't to purposefully kill a black kid, which is what will be said, but it's still a terrible decision that basically eliminated any other possibility. The driver is as much responsible as the kid and the shooting officer.

so he should receive no punishment for accidentally gunning down a kid that turned out to have a fake gun? I don't think he did this with cruel intentions but the weight of his job was too much for him. He made a mistake.
Yea, I do think pulling up at a high speed and right next to the suspect isn't the best tactic. It clearly didn't work out well since he jumped out the car and splattered the kid. The video looks like the park was cleared so maybe they didn't need to pull that close. I would think they could handle it from a distance if there are no other children in the park.
The kid was stupid but at 12 that is what happens. The caller is partly at fault, along with the operator for not relaying along that the caller believed it was a fake gun.

I just stated what happened in the video. You're the one who made up this story about a frightened innocent playing child who was scared and hiding his toy gun from the policeman...you somehow pulled out emotions and facial expressions from a 140p choppy video. You want to deny that the kid was walking towards the cop car with his hands fiddling with a gun? Re watch the video.
Should he have been shot? No. Did the officers have reason to believe he may harm them? Yes. They were operating under the assumption that it was a real gun thanks to the dispatcher withholding information. Rookie cop felt threatened and fired. I think he should lose his job, but anything more than that is ridiculous.
