If it was a passing zone, you still would have the right of way as you are going with the flow of traffic and the passing driver was in the lane of oncoming traffic.

I had to do a driving class for an open container violation and the instructor discussed this point extensively.

Person passing on the left has possession of the lane first and therefore has the right away, person turning would be at fault

100% wrong! Had a guy hit my friend when he passed a guy. The other guy was at fault according to the state trooper.
