But on Friday, Sandusky city prosecutor Lynne Gast-King dropped both of their obstruction charges without prejudice.

"The elements of the charged offense of obstructing were not established," Gast-King said.
But the prosecutor said the pair still appeared to have acted unlawfully:
"All of the elements of Failure to Comply with the Order of a Police Officer were present and would have applied to the conduct of both of these individuals. Law enforcement officers have been informed that, in the future, Failure to Comply should be charged under this fact pattern," she said.

Stockett addressed Gast-King's comments Monday:
“The charges had to be dropped. I'm not happy, I'm not upset —they're dropped because they had to be dropped. The reason I am upset...is instead of her admitting that the police department is completely at fault, what she did was push the blame back on us, that we could have been charged with something else,” he said.

“There's no way in the world that you should imply what we did was wrong, because that only (implies) what the officer did was right,” Stockett said.
