True, but it also depends on the language in the conditional delivery form.

That's what I was referring to. I was using a hypothetical situation where he somehow did not have the conditional spot delivery and somehow actually did have a purchase agreement with real specified terms that was signed. In that unlikely case, he may not have to take the vehicle back (which is what I meant by own it), but he would still have to pay.

I still agree, though, that the more likely situation is that he did sign a spot delivery form.

I also tried to point out that some dealers try to use tactics like this as scams to get higher rates and/or payments.
