They should make a movie about this... Matthew Mcconaughey could be the lawyer and some one with some real fire like Samuel L Jackson could be the vengeful father.

Barajas explained that he is bitter about be prosecuted, but is praying for that the Banda family get their justice.
Barajas said he is not sure who killed Banda.
I'd just like to know who else had motive and the time to commit this crime? Or the opportunity?
I get all that is circumstantial, but who else did it?

yes, he's a murderer, you idiot
bingo, and if this guy used lethal force to defend his life he'd be committing another crime

A search of Barajas' home found ammunition that is consistent with the bullet that killed Banda, but authorities have not located the weapon used in the shooting, Sanders said. He added that the case is "going to be much more difficult if we don't have a weapon."
The gun was the key but they never found it. Same bullets/ casings were found in his home.
From the original piece when he was charged:

From the KHOU link that was posted.

But prosecution witnesses told jurors during questioning by Cammack that more gunfire had taken place well after Banda was shot - pointing to the possibility that the actual shooter was still at large - and that a search of Barajas' home failed to find any evidence that directly or indirectly linked him to the crime scene.
Cammack also suggested that Banda could have been shot by his own cousin or half-brother, who told investigators that they witnessed the crash but fled the scene.
There were others who witnessed the crash that fled the scene.

But what motive would they have? Had they just committed a crime together (besides killing the two kids that is)?

From memory:
He did not have gun residue on his hands.
Did not have enough time to go home get gun, return to scene shoot guy, return home with gun and then return to scene.
What's crazy is if he didn't do it, then he had a very bad day.
Drunk kills kids.
Drunk gets murdered same day and he appears guilty.
If that was a movie we'd all bash it for how stupid it was. However, it may have happened in real life.

Correct. Also, no witnesses at all. There is absolutely nothing putting him even at the scene of the crime much less anything proving he did it.
Uhh, pretty sure there were witnesses that saw him walk to and from the scene.

Not even close, and you're lame for even attempting that count.

What vexes me about it is the statement that the father would not have known of the drivers alcohol level at the time...so in his mind he wasn't killing someone for drunk driving that killed his kids, only an auto accident on a dark road.

Not one witness said he was the shooter. His house was 100 yards from the scene of the accident/crime.

Im not going to read this whole thread but this was not jury nullification aka "a time to kill" or the plauche shooting. There was no GSR, no gun, no witnesses who saw him with a gun, two passengers with the drunk driver who fled into a field and the state's ballistics expert who testified the evidence was "shaky". I love all you fricking amateur lawyers. frick off.
