Amazing how so many people want Tony Stewart to be guilty of manslaughter when clearly a dumbass hot headed 17 year old who clearly wrecked as he was behind Tony, (kids fault) gets out in a BLACK outfit on a poorly lit track and gets hit. Any one else and this would have already been declared an accident by all.

It looked like an accident during a motor sporting event to me.

And while people are still going to debate the point, Tony Stewart did nothing to be legally charged for.

Stewart was clearly displaying aggressive behavior and wanted to scare the kid or spray him with dirt or something. I doubt he wanted to kill him, but it doesn't matter - his reckless behavior resulted in the death of a human being.

Stewart is one of the best drivers on the planet and saw everything taking place at least 5 seconds before he got to the area. It's not like he had his eyes closed and suddenly opened them in the turn to try and swerve and avoid the kid.

I've seen some dumb threads on TD but this bitch takes the cake. I didn't realize how many dumb mf'ers are on this site. I can't believe the number of posters who think this was done intentionally. fricking idiots.

We don't know enough about the case yet. I'm sure he will be charged though. Too much free pub for the DA

Who is the local DA? That will have the biggest influence on all of this.

Also, if no alcohol or drug tests were taken from TS yesterday, that will come back to haunt the police.

When it is all said and done, I bet he will be charged for something - and he will be found not guilty or the charges dropped.

Example - I am playing golf...piss off the drunk guys playing behind me. They hit into me while I am 250 away - the shot hits me I. The head and kills me. I assumed the liability when I stepped onto the course. My estate would likely win a civil suit....but that is it.

Again - who is the local DA?

Zero percent chance he gets any jail time. The dude walked into the middle of the track and intentionally got in front of his car. His fault he is dead

To me the car in front of TS having to swerve to avoid hitting the kid helps TS in this situation. Looks like just an awful accident.

At the moment I'm thinking involuntary manslaughter. No jail time, but civil case will clean TS clock.

Kid is in the middle of the track where he shouldn't be. Cars are moving fast and obviously volatile. There is enough reasonable doubt there.

I'd be really surprised if he goes to jail, but this will cost him. The kid was wrong to do what he did, but I don't think he deserved to die for it. All Tony had to do was go lower on the track, to avoid the guy; the race was under caution, so no reason for him not to. I don't know if there are multiple videos, but in the video I saw with audio, it is obvious Tony was trying to send a message. I don't think he meant to kill the guy, but he was definitely sending a message. I have a hard time understanding how people could have watched the video that I saw, and have a little racing knowledge, and think Tony did nothing wrong.

I think Stewart and the guy that he hit were both kind of coming at each other aggressively.Stewart had a car whereas the other guy had a helmet and a fire suit.

Let me start off by saying, I couldn't care less about NASCAR, hell its not even a sport in my eyes, but thats for another conversation.

After watching the video, I can not put any reasonable blame on Tony Stewart. Is it possible he meant to hit the guy? Sure. But there is too much reasonable doubt to convict in a court of law. The fact of the matter is the young man stepped unto a racetrack with cars speeding by. NOTHING good can come from those actions. Looks to me like he just avoided getting hit 2 other times. So if Tony didn't hit him, somebody else likely would have

Look at it this way, when you are a little kid. Your mom used to always tell you "GET OUT OF THE STREET!" Because she knows there is a good possibility that you can get hit. Unfortunately this young man decided to play with fire, and he got burned. End of story. I feel bad that it had to happen, and I send my condolences to the family. But I can not say with a straight face Tony deserves to go to prison for what happened.

Too early to tell at this point. From what I've seen and read thus far I don't see enough evidence to warrant the filing of criminal charges. Of course once the investigation is complete other things may come to light.
