we don't know if either one was drunk for sure. just that they were seen drinking by witnessess apparently

You'd be surprised how crazy shite gets up there for concerts.
Was there last month for a show and the sloots were out and about like crazy. Bros wearing their cutoffs and 1992 Dream Team Jerseys ( ) with high school chicks and their tits hanging out
I saw at least 15-20 underage bros and broetts get arrested

i think he means that after she realized she was being videotaped, she claims that everything else that happened prior to that point wasn't done with her consent
yeah.
I know on the OT you're supposed to have one hard-lined opinion and stick with it, but this girl's story is a little hard to believe. Hopefully there were enough eye witnesses prior to video to get it sorted out one way or another.

Murphy and the victim met for the first time during the Xfinity Center Amphitheater show, where both had been drinking alcohol.

That's true. I was just pointing out that you can stop consenting in flagrante delicto.

They were drinking????
But...but.... they're underage. How does that even happen??

So that means they are drunk?
Posted on 7/30/14 at 10:15 am to TheDrunkenTigah
exactly.. the story seems a bit far fetched to me. sounds like the guy and girl were both drunk making out in a crowd and she got spooked once she saw people filming her.

i'm telling y'all, this is a big, developing societal meme. it's one of those things society is going to have to sort out, and we don't really have a societal policy yet. just like tweens sexting. technology is advancing past our concepts of morality (and clashing with a system of criminal codes that cannot keep up)

Can't consent with alcohol seems to be the usual defence for drunk girls, so drunk enough might be the better term.

Is there legal precedent to back that up?
Posted on 7/30/14 at 10:17 am to prince of fools
if she is using the "i was drunk so I couldn't consent" defense and she's 17, shouldn't she be charged at the very least with MIP?

More simply, drunk doesn't always equal incapacitated.

Our society is shite-awful at sorting things out. We'll just make a reality show out of it and then some Lifetime movies, but in a few years it'll be the plot of a quirky romantic comedy movie with Cameron Diaz.
