Drunk Adult passenger with 15 y/o permit only driver. Gets pulled over.

What happens if an adult driver with valid driver's license is intoxicated while supervising a driver with a learner's permit?
DWI for adult passenger? Cruelty to juvenile? Nothing at all???
This question came up in the office the other day. Just curious.

I would think reckless endangerment for the adult since the 15 year old isn't licensed.

in GA I believe they would both get in trouble. Certainly the kid would be ticket because the adult would not be a proper supervisor. It is the permit holder's responsibility to follow all requirements.
I think the adult would not be ticketed, but would be arrested for child endangerment.
GA laws around this are very specific and severe due to some dumbass parent who didn't teach his kid to drive right & the kid went & killed himself.

So the kid needs to conduct sobriety checks or will get ticketed? I seriously doubt that

I'm at home and not going out tonight so this isn't about me...plus my kids are live with their mother in another state.
I'm just curious what would happen....certainly this has taken place before.

Im pretty sure thats against the law. Supervising driver has to be sober with a license and over 18

I agree 100%, but what would the "charge" be?
ETA: I just figured there were some lawyers on here that might know....then again, they are probably all out drinking and driving their boats on the river today!

I believe here in Alabama, this does not constitute a problem.

I don't think the kid should receive a violation either, but then again....you must take responsibility when you get behind the wheel....regardless!!!!
