Why would anyone think that an email from the IRS employee responsible for tax exempt entities discussing granting and/or denying tax exempt status to specific organizations would be emails created or received in the transaction of agency business? If she was doing her assigned job duties when writing or reading the emails, then it was in the transaction of agency business.

I suppose Lois Lerner was just acting as a concerned private citizen creating and receiving all those emails on the IRS mail server. Not even you can pretend Lerner's work product was not generated in the transaction of agency business.
