State and local laws can, are and will be oppressive just like federal laws are. When they discriminate against property rights in a manner like this story, they need to be scrutinized. Just like federal laws violating property rights are scrutinized. When a law violates the constitution, no matter what level it's at, it's brought to attention and dealt with.
This isn't a good argument.

The difference is that local and state officials require far fewer voters to remove them from office. That's why federal office holders act with such arrogance.
