Based on this, shouldn't bait cars be illegal for police to use in arrests? I know nobody is dying there, but still.
Guy deserves jail time, don't get me wrong.

This. Law enforcement does this on the regular, but it's ok for them to do it. I agree that he deserves to do time based on the other facts of the case.
Side story:
One of my dad's friends was having trouble with kids in the neighborhood hitting his trash cans and making a huge mess when he would put them out at the road for pick up.
One day he decided to fill them up with concrete. Sure enough that night he heard the kids hit the trash cans and demolish their vehicles. Was it baiting? Maybe, but it taught them a lesson.
This guy could have stopped at getting them to commit the crime but he didn't so, unless there were other circumstances that were not mentioned, he deserves to do a little time.
