Suffice it to say that there is history behind the executive not enforcing laws. Sometimes it's ok, sometimes not. It sucks and it blinds us to absurd things that are still on the books. Is this legal? Probably. Doesn't mean it should be. Think federal pot laws, DOMA, separate but equal statutes in the south until the last few years. Executives don't enforce law all of the time.

That's one thing in itself but modifying and changing the law without congress is another entirely.
