Nope, they had the dinner with him drunk. Remember Marty even tried to have another cop buddy excuse Rust from dinner for work, but Rust refused on the phone.

According to what we think happened, Rust stayed. He refused the ride home.
And Marty had on a sweater at the dinner. He never had on that sweater that night.
