Hunting Lease Liability

My dad has a friend that is going to let us hunt on his land this year,he dosent want to be held responsible if anything happens.He has suggested some kind of insurance.Could we just sign a liability form instead of getting insurance?

i would think that you could sign some sort of binding contract but, i'm no lawyer.

Its fairly cheap. I just leased 507 acres and got my insurance through the LA forestry association. I think the minium cost is $230, ($180 for insurance and 50 for memebership dues) inculdes memebership for you and the land owner in LA Forestry and coverage up to 500 acres. The liability covers you and the landowner ($30 for landowner coverage). $1,000,000 each occurance, with $2,000,000 aggregate with zero decutable. If its over 500 acres its .13 an acre.

The person I leased it from is a lawyer and I consulted my lawyer, both said a hold harmless waiver is good to have and standard in most lease agreements, but if something actually happened - Hunting acccidents tend to be fairly serious when they occur, the waiver would most likely not hold up in court.

I require it on every property that I lease.

Check with the LA Forestry Association, NRA, Alabama Forest Landowners.....there are several others as well, should cost you no more than $.50/ac all told, you buy membership for yourself and the landowner then a small per acre fee.

If he's kind enough to let you hunt, cover him.

Its always been my understanding that a good lawyer will convince a jury that the wavier you signed was just proof that the landowner knew it was dangerous and he let you do it anyway.

You'll probably want to go with both hunting lease insurance and a Hunting License Agreement that contains indemnification/hold harmless language. It's also a good idea to have each member sign the Agreement so that they personally agree to all of the language, as opposed to having only the president of the lease sign on behalf of the membership (unless your lease has a partnership agreement in place). It's also a good idea to have all gusts sign a waiver.

WE did this along time ago in Tallisheek on a friends aunts 600 acres...formed an official hunting club and used the buck masters insurance plan tat was available at the time...not sure if it still is...

So would everybody in the lease need to buy coverage or can I buy it under a hunting club and it cover everybody? Thanks for all of the info

From a club and list clubmembers and you are good.


Also, do as Gaucho said, execute a formal lease. Protects everybody.

You're really just buying a free defense. Those policies don't really cover much.
