Nobody is accusing him of anything. We're just using this as an opportunity to reiterate the risks of hauling arse on the water.

You are being obtuse in not acknowledging that risk goes up exponentially with speed in a boat. Sure, he could have been killed at 35 MPH, but that doesn't mean it isn't safer.
