Bond Forfeiture

I'm suppose to be closing on a house at the end of this month and the lender just called me and said there was a bond forfeiture on my account. I was completely unaware of this, when I called the courthouse they said it was from a reckless operation back in 2005. I was never notified of anything I was suppose to pay, is this something that was suppose to be paid by the bail bondsman. Also I don't think the bail bondsman is even in business anymore. Not sure what really to do on this and any help would be greatly appreciated.

Call the DA's office and they will look into it. if you made your court appearance then they will cancel it from the records. If you failed to appear then you owe the money. good luck

GMFS is the lender and I think AMG is the title company.

If you went through a bondsman, then the court can only give you proof that you went to court within a specified amount of time.
When you bonded out and signed your papers with the bondsman, you and the indemnitor agreed to pay the full amount of the bond if you do not show up for court. Once the court revokes your bond, the bonding company usually has 6 months to get you into custody or court. If they do not, the court can then require the full amount from the bonding company. if this happens, the court is out of it and it is between you, the bonding company, and their insurance company.

Call the title company as it is there responsibility to sort this out. I do about one of this a week and rarely is money still owed. if you went to court the DA will cancel the bond forfeiture, but again the title company will usually handle this on your behalf.

If the bonding company paid the full bond to the city, parish, or whatever municipality it was, then the DA can't do crap. It is a debt owed to the bonding company. In your example, the bond company hasn't paid the full amount of the bond. The OP needs to check to see if he went to court in time and if the bond has been paid by the bonding company.

Call AMG title and ask for an update. This is what you are paying them for when you purchase a title policy. If any money is owed to clear the lien they will let you know and it will have to be paid at closing.

This was almost 8 years ago so im not sure if I missed court or not, but I know this went on for a few years with having to reschedule dates and them losing paper work. If for some reason I did have to pay the amount, is there anyway to have the lending agent pay it and roll it into my monthly note?

First make sure its a valid lien before you start worrying. Like I said, I see these all the time and usually it involves exactly what you said where courtdates keep getting rescheduled. They will issue the bond forfeiture then never cancel it when you do appear. However if money is owed (which the title company will find out for you!) then it is probably too late to roll it into your loan and still meet the closing deadline. The lender would have to qualify you for the larger loan amount and you have probably learned already that lenders suck. But call GMFS and ask...after verifying the debt!

Well I called the lady at the Court House and she made it seem like the money needed to be paid. But if I did end up going to court then I shouldn't have to pay? I even contacted the bail bondsman insurance people to see about resolving the matter.

If you want to do the title companies job for them then call the DA's office. Sounds like you called the clerk of court...they will know about as much about it as you do.
if its 19th JDC...call 225-389-3400...ask for Debbie...she handles bond forfeitures.

I called the DA's office but the man I spoke with said that they do not handle city court matters. I have the title company working on it also but I like to be proactive and not leave anything to chance.
