If Goodell can prove that the NFL did in fact warn the Saints not to continue such a program, and the Saints ignored that warning, then we are still in some shite.
Obviously the NFL's focus on safety, or at least a need to be publicly perceived as a "safe" league has become more of a priority recently.
But if there was little or no actual warning to the Saints than we are getting screwed with all this.

But then if this is the case the players wouldn't be suspended, because I don't think that would fall into his "conduct detrimental to the league" jurisdiction

I think it would, all Goodell would say is that the policy has changed about paying for "big hits", that he warned the Saints specifically and that they chose not to obey, hence conduct detrimental to the league
