re: Penn St. BOT Intend to Appeal Sanctions

Actually, quite a few people feel like the NCAA was within its bounds to apply the sanctions. It's a voluntary organization & its executive committee, made up of 18 university presidents, made the decision after obtaining several legal opinions from its attorneys. The words "lack of institutional control" can cover a wide variety of violations. Obviously, many disagree as well, but there are quite a few who do agree 100%.

I can't believe that anyone actually thinks that the NCAA was within their authority to issue these penalties for something that does not have anything to do with player eligibility or following the NCAA rules.
You mean like covering up a sexual abuse scandal that if let out would have negatively affected recruiting? Are you naive enough to think that had news of this broken sooner, it would have made some recruits think twice about going there?
College Football teams are brands. Anything that negatively affects the brand affects recruiting.

You're suggesting that anything which could negatively effect the brand is under the jurisdiction of the NCAA? Or that anything that could cause a recruit to not want to go to the institution? That gives the NCAA nearly limitless power over the entirety of the school's decision-making processes.
That would mean that the NCAA could crush Arkansas, for instance, for Petrino's mistress stuff.

This is a silly comparison that I wish people would stop using. There wasn't a massive cover up in the athletic program and the NCAA would never garner the support to do what they did with Penn State over a mistress.
Hell, they can't even get unified support in doing what they did with Penn State. So how can you make the argument that they could get everyone on board for something like Petrino's case? You can't. So please stop.

why does no one think the BOT was involved in this cover-up?
why the frick are they still even on the board?

There's a nearly 400 page thread on the Penn State scandal on Buckeye Planet.
The NCAA can sanction Penn State because they violated the morals and ethics clause in the NCAA bylaws by covering up a pedophile in their midst.
Also, the sanctions imposed are those suggested by and agreed to by persons at Penn State that had the authority to sign the consent decree.
Comparing the situation at Penn State to Arkansas and Petrino is absurd.

ULLLLLL won an injunction in Federal court as well, permitting them to play in the NCAA basketball tourney. They got to play, went one & done, and then the NCAA stepped in & hammered the basketball program with the death penalty for 2 yrs or so.
seems like the risk they are taking is obvious

Penn State will find out that challenging the NCAA is like challenging the IRS. You may win one small audit, but in the end they have you by the balls & you are forever under their microscope.

As well, any & all appeals will simply make the lawyers richer & suck more money out of the coffers that may be needed to pay off the civil suit settlements
There was a moment where it looked like the adults at PSU were finally stepping forward to take control... the BOT members involved in this are submarining their ability to put all this ugliness behind them.

No comment on the appeal, but has the NCAA stated where the $60 million is going and why they should be given that money to do with as they see fit?

I seem to recall that the NCAA specified that the money must be used for programs dealing with child abuse (but not for programs under Penn State's control). The money is not going to the NCAA.

maybe I misunderstand your question?
did you not see the announcement of the sanctions from weeks ago? they talked about that in general terms then (it was pretty near the first sentence of the announcement)

I didn't read the announcement because the sanctions were posted all over the Internet. That's all I was really interested in at that time.

maybe they will soon

Obviously, not reporting a child predator is extremely morally repugnant. However, many would say that providing a job for a mistress and hiding it from the school is also immoral and unethical. So, what portion of the action of covering up an immoral act is it that 'activates' the morals and ethics clause?
Is it that there were four more people involved in the cover-up?
Is it the severity of the crime?
Is it the identities of those who covered the crime up?
Is it that it had a possibly large effect on the football program's future?
Comparing an ethics violation to another one is not absurd when they are no different in the jurisdiction that the NCAA has over them. There is nothing about the PSU scandal that calls for NCAA interference more than the Arkansas scandal.

Arkansas didn't go on for 14 years, involve multiple members of the university and multiple victims.
Unless I am missing something.
