Second Degree Battery

May be Germans.
From the state legislature's web site:
According to the initial BRPD statement, the victims drove themselves to the hospital for minor "cuts and scrapes".
That does not sound like "serious bodily injury".
If any of the players are charged with second degree battery, prosecutors will probably have a hard time making those charges stick in front of a jury.
From the state legislature's web site:
quote:
§34.7. Aggravated second degree battery
A.(1) Aggravated second degree battery is a battery committed with a dangerous weapon when the offender intentionally inflicts serious bodily injury. (2) For purposes of this Section, "serious bodily injury" means bodily injury which involves unconsciousness, extreme physical pain or protracted and obvious disfigurement, or protracted loss or impairment of the function of a bodily member, organ, or mental faculty, or a substantial risk of death.
B. Whoever commits the crime of aggravated second degree battery shall be fined not more than ten thousand dollars or imprisoned, with or without hard labor, for not more than fifteen years, or both.

Let's not get too optimistic. You can have a broken jaw and drive. That sort of injury leads to a second degree battery charge in most bar fights. I have seen these plead down if the medical bills are paid by the attacker. Simple battery for first time offenders usually get a fine or get into a pretrial diversion program.
The felony charge is very serious and could result in expulsion from school.

Or anywhere official. The only place I heard one was worse was from the marine's friend.

I'm curious, was everyone drunk? When did the victims report this to police? Did the victims report it when it happened, was there a blood alcohol test done? I can't help but think this is just another typical alcohol induced fight in the parking lot of a bar. I'm not even sure the police like to make arrests in this case unless there are firearms or drugs involved.
I'm most pissed about JJ showing no senior leadership in regards to breaking curfew and then heading to a bar. Coaches preach to these kids constantly about not getting involved in situations like this and here we go.
On a side note was any football player illegally at the bar in regards to his age?

I thought they were talking Second Degree Battery, not Aggravated Second Degree Battery. Whole new ball game if weapon was used.

You can be at a bar if your'e over 18 years old, just not drink.

Second degree battery is this:
quote:
§34.1. Second degree battery A. Second degree battery is a battery when the offender intentionally inflicts serious bodily injury; however, this provision shall not apply to a medical provider who has obtained the consent of a patient. B. For purposes of this Section, "serious bodily injury" means bodily injury which involves unconsciousness, extreme physical pain or protracted and obvious disfigurement, or protracted loss or impairment of the function of a bodily member, organ, or mental faculty, or a substantial risk of death. C. Whoever commits the crime of second degree battery shall be fined not more than two thousand dollars or imprisoned, with or without hard labor, for not more than five years, or both.
