if i bought a house befor I got married, and my wife has never owned a house, would she qualify as a first time homebuyer?
ETA: quick research
only eligible if buyer or spouse has never owned a house. There is a less publicized repeat home buyer credit for up to $6,500

Thats the new extension.. But the rule is that both of you would have had to not own a home in the last 3 years. Its not never its last 3 years. Not really sure how they check that though... Seems like she could file the amendment or 2009 taxes and since she has never filed listing that she owned a house before she would get it. I would guess thats the only way for them to know if you have owned a house before is if you have claimed it. Well she has never claimed it. You can split it and each file for 4k but you are not required to do it that way..

Negative. The new 'repeat home buyer' deal is that you get a $6500 tax credit if you buy a new or used house if you have owned a home for 5 of the last 8 years.

What was wrong about what I said? I was saying that the 6500 was the NEW bill that gave the extention and then started talking about the 8000 tax break for first time buyers..

This was unclear. You switched gears and didn't say which program you were talking about. No big deal.

My fiancee and i purchased a home in August. We put the house in both of our names. She has never purchased a home before, but i have purchased several. When she does her taxes, will she qualify for the home credit? Even though my name is also on the name. We plan on getting married next year, but will do it after the taxes have been filed. What is the best way to file for us to utilize the tax credit? Thanks...

This will fall under the unmarried joint buyers. I believe she is eligible for $4000 of the $8000. Also, it doenst matter when you get married or file as long as you were not married when you bought the house. If you would of been married before buying the house neither of you would of qualified.
