After an officer made contact with the driver, McCormick, the officer smelled marijuana coming from the vehicle.

The officer asked McCormick to exit the vehicle, but McCormick refused and demanded a supervisor. After the supervisor arrived, the officer had McCormick exit the vehicle and then took him into custody for failure to comply.

McCormick was then searched, and officers found drugs inside his underwear, including crack cocaine, marijuana and 12 bags of spice with a distinct eight-ball logo on them.

Officers then searched McCormick’s vehicle and found unused bags identical to the ones in his underwear and bags with a distinctive red bulldog logo.

An expert at the Mississippi Forensics Laboratory testified that the crack cocaine totaled about eight grams and that the spice totaled about 10 grams.
