Peter's 9 year sentence for trying to preserve the hard drive image of the voting machines in 2020 is longer than many of the violent criminals she's in prison with........chew on that.

If tweet fails to load, click here. The Colorado Attorney General’s office has filed a response opposing the release on bond of Tina Peters, the former Mesa County Clerk, despite a fifth assault against her just four days after the Court of Appeals heard oral arguments in her case.
On 18 January 2026, 70-year-old non-violent offender Tina Peters was assaulted by a 29-year-old inmate currently serving a six-year sentence for aggravated assault. In response, prison officials placed
Peters in solitary confinement while returning her assailant to the general prison population.
“This sent a sent a message that any inmate who assaults Mrs. Peters will not be held accountable,” Peters’ legal team stated in their January 30 petition for bond pending appeal.
Rather than address the escalating safety crisis, the Attorney General’s office filed a response arguing the petition is procedurally defective.
The trial court’s original denial of bond was based on Peters’ public statements criticizing Mesa County’s computer voting systems, speech protected by the First Amendment. Court transcripts show the trial judge explicitly cited disagreement with Peters’ characterization of election security vulnerabilities as grounds for denying bond.
Peters’ appeal challenges eight counts of conviction, with oral arguments heard by the Colorado Court of Appeals on January 14, 2026. The court extended briefing deadlines by 21 days on January 29, meaning Peters faces a minimum of 63 additional days in an environment her attorneys describe as “unsafe” unless bond is granted.
The January 18 assault marks the fifth attack against Peters since her incarceration at LaVista Women’s Correctional Facility in Pueblo. Each assault underscores the failure of prison officials to protect a senior citizen convicted of non-violent offenses.
Tina Peters was never a flight risk and poses no danger to the community. She was released on a $25,000 bond throughout the trial proceedings without incident. The only thing that has changed is that she exercised her constitutional right to appeal and paid for it with her freedom and her safety.
The State’s response makes no mention of the January 18 assault and offers no alternative measures to ensure Peters’ safety while her appeal is pending.
Peters’ attorneys are seeking immediate reinstatement of the $25,000 bond under which she was released during trial, arguing she meets all statutory and constitutional criteria for release pending appeal.
