5th Circuit has reversed 2 district court habeas orders concerning noncitizen detention

What the 5th Circuit just ruled

The U.S. Court of Appeals for the 5th Circuit (which covers Texas, Louisiana, and Mississippi) ruled that:

Noncitizens who are in the U.S. without being formally admitted
(for example, people who crossed the border and were never paroled or admitted)

must be detained by ICE
with NO right to a bond hearing

while their removal (deportation) case is pending

Even if:

They’ve been in the U.S. a long time

They aren’t accused of any crime

Their removal case may take months or years
