Brian Kelly lawsuit: LSU claiming it has not 'formally terminated' coach
quote:
In a legal filing against LSU's board of supervisors, Brian Kelly's attorneys say LSU has taken the position that it has not "formally terminated" Kelly as the Tigers' football coach.
The school, according to the petition for declaratory judgment, is now seeking to fire Kelly "for cause" and potentially avoid paying a full buyout of nearly $54 million. The filing claims that LSU informed Kelly's representatives of this position Monday.
According to a copy of the suit obtained by ESPN, "LSU's representatives had a call with Coach Kelly's representatives, where LSU took the position that Coach Kelly had not been formally terminated and informed Coach Kelly's representatives, for the very first time, that LSU believed grounds for termination for cause existed."
The 48-page lawsuit was filed in the 19th Judicial District for the Parish of East Baton Rouge (Louisiana) just hours after this call.

Seems like LSU hasn’t formally terminated BK because they have to give a 7 day notice (I think that’s the correct amount of time but I could be wrong) if they want to fire him for cause. They don’t have a great case to fire him for cause so they are trying to but time. Also using this as a tactic to force BK to settle.

I wonder if the presser where they said they fired him counts as “proof”?

Yep. It’s going to drag everybody through the mud.
I hope folks are used to C grade coaches. No one is going to want to come to LSU to coach when they won’t honor a contract.
This is some Al Davis type shite lol.

As proof of firing him…
If you come out and announce that you let fired someone… doesn’t that mean that you indeed have done so?

LSU looking bad in all this....trying to wiggle out of a contract. Any coach that agrees to coach LSU is now gonna want an ironclad contract that says you cant even fire me for cause.

quote:The statement alone wouldn't really mean anything. Kelly would have to consent to the termination of the contract. A court could find that his thank you letter to the school/fans/program whatever constituted as consent to the termination of the contract.
I wonder if the presser where they said they fired him counts?
We'll see.

LSU should pay the man and honor the contract that both parties agreed to, instead of trying to weasel their way out of this.
If there truly was an issue prior to termination with Coach Kelly (and I am no fan of his), there should be written documentation — just like there would (or should) be for any other person working in the state, federal, or private sector from his boss, Scott Woodward.
Coach Kelly was a disappointment at LSU, but that has no bearing on what was agreed upon by both parties. LSU made a terrible mistake with hiring Kelly, but that is not Kelly’s fault.

Dumpster Fire.
Prospective coaches are watching their phone buzz when they see 225.

You have to formally terminate the contract. You can’t just say “you’re fired” and have that count. Especially when you are dealing with tens of millions of dollars of possible settlements that need to be made.
And if LSU wants to make the argument that it does count, that’s going to hurt their argument of them giving him a 7 day notice prior to his termination for cause.

Agreed.
I mean if O wasn’t terminated for cause, I seriously doubt they will have a leg to stand on with Kelly.

If I'm Kelly I'm going on the field on Saturday and putting a headset on since I apparently still have my job.

Obviously.
I mean moreso that if they are having a presser to announce the firing…I’d assume that they have actually went through the process already.
