Sorry to post a thread asking but I haven’t been able to find it. I know it’s out there because people have posted it before. I’m trying to find out if the full buyout is due as liquidated damages or not.

I read it earlier and I don’t blame BK for going after the full amount owed. It’s not his Fault LSU signed him to the dumbest contract ever. That is Woodward legacy: idiotic contracts

Woodward had no financial input on that contract other than to get approval from the BOS/TAF on the amount he was authorized to offer. And the language is 100% legal boilerplate.

F Woodward. He’s a “steaming pile of” donkey shite.

So for anyone who is wondering under section 11(b)(3) of the contract it is very clear that Kelly IS NOT entitled to a lump sum payment of the full $53 million or whatever it is but he IS entitled to 90% of the full salary he would have made paid out in installments under the term of the contract, less any amounts he earns in other employment.
If you’re Kelly, it would not be unreasonable for you to settle for $30 million lump sum and then go somewhere else and work and earn a few million a year to where you’d actually come out ahead. If he doesn’t want to work, then that’s a different story and if you’re him you’d just wait it out.
The “for cause” provisions of this never have to enter into the analysis at all nor should they.
If the nola.com report is true that Kelly’s lawyers are claiming he is entitled to a $50 million plus lump sum payment, then they are really just posturing in a pretty silly way that tells me they are looking for a settlement and trying to maximize it. Fine that is their job.
For us as fans the bottom line is there is likely to be a settlement which is good for LSU in the long term.

For a not-for-cause firing they are due 100%. Paid in equal monthly payments over the remainder of the contract period. This is his base pay, other forms of comp like benefits and performance bonuses are not payable.

I didnt think NOLA said he was looking for the full payout lump sum. It said his lawyers demanded that LSU commit to paying the full buyout per the contract which they have not done yet. Currently he is still being paid monthly regular salary.

You are right I read that into the article. They are asking him to confirm they will pay it out in writing. Which LSU does not have to do and if I were LSU I would tell him to kick rocks. What’s he going to do? Sue LSU for paying him his monthly installment payment? It’s a tactic by his attorneys.

What happened to the Morals Clause?
Thought he’d get nailed on that.
He really just needs to shut up and GO AWAY.
