Louisiana will ask Supreme Court to overturn key part of Voting Rights Act, invalidate map

Louisiana is now urging the U.S. Supreme Court to rule a key section of the Voting Rights Act unconstitutional, which would throw out the state's congressional map that has two minority-majority districts.
“The Constitution forbids sorting voters by race. And telling legislators drawing maps to think about race, but not think too much about race, is an untenable standard,” Louisiana Attorney General Liz Murrill said after releasing Wednesday afternoon a 58-page brief filed with the Supreme Court.
Louisiana had previously defended the maps, saying they had created them under protest when a federal judge ruled a previous map with one minority district unconstitutional. But, after the Supreme Court asked for arguments on whether Section Two of the Voting Rights Act of 1965 is constitutional, the state changed direction.
“We have consistently argued that the U.S. Supreme Court’s redistricting jurisprudence needs to be drastically changed or overruled,” Murrill said. “By requiring state legislatures to draw maps that sort voters by race, it forces us to violate the federal Constitution."

Good.
VRA and courts have been asking for contradictory things and have used portions of the VRA to bludgeon most of the South over it since the 60s under conditions that were supposed to be temporary yet no one wants to release them.

Lawyer types…any chance the state will actually prevail? I’m not confident that Roberts and ACB want the heat for overturning even a portion of the VRA. What say you?

The Supremes asked for argument on this point specifically. That means that at least four and probably five of the justices are seriously considering ruling in Louisiana’s favor.
Ruling for Louisiana would eliminate an entire class of particularly vexing litigation. Judges love getting rid of these types of cases.
A ruling for Louisiana also strongly strengthens the Court’s recent rulings in the college admissions cases.
I am not certain that Louisiana will prevail, but it seems like there is momentum on the Court to vote in their favor.

The Voting rights act, which has been interpreted to allow creation of districts based on race conflicts with the Constitution's equal protection clause prohibiting discrimination. When a statute (or its interpretation) conflicts with the constitution, the Constitution must prevail.

Some District judge will overrule the Supreme Court and reinstate the map.

Having half of Baton Rouge in a district with Shreveport is almost as crazy as having Bogalusa and Monroe in the same district. Parishes/ counties should be in the same district where possible. Some sort of geographic continuity should be involved.
Sometimes having 40-45% representation doesn’t stop you from electing your candidate. it does require a more moderate candidate that represents all/most people.
