If someone is breaking into your home should you be allowed to defend yourself using lethal force? Assume that you could allow them to take the property they want and leave without violence occurring.

Not just your home, but all of your property. If someone enters your property to steal and/or cause you harm you should be able to send them to meet God with no questions asked.

Yes and I am 100% sure I would not be indicted much less convicted for doing so where I live.

I think you should be able to shoot someone dead breaking into your shed to steal a rake, but I'll admit I'm probably on the fringe.

Bit of a necro (sorry!) but I realized I hadn't given my two cents. I think the law should be on your side in a situation like this, but if someone's very clearly retreating and poses no further threat to you you shouldn't be able to execute them. Where it gets tricky is if they've already taken some of your stuff, I think you probably (morally) shouldn't shoot someone if they aren't taking anything of too much value, but you should (legally) be allowed to defend your property.

BS. You don't know if the criminal is working alone. You can't take your eyes off of him to search or call 911. Plus, the average citizen in a high pressure situation is not equipped by any life experience to deal with any of this. He shouldn't have any burden to think about this. The criminal sacrificed a lot of his rights when he chose to commit a crime.

I don't agree that you sacrifice your rights when you commit a crime, I think part of what makes America great is our judicial system, that said you make a good point. It isn't fair to expect an average person to make that kind of assessment. That said, if you are (somehow) able to know for sure that a criminal no longer poses any threat to you, you shouldn't kill them.

First off, I edited that last sentence slightly.

Second: exactly what situation would that apply to? If I go home, something feels wrong, and I find a guy in my house and shoot him, then, what am I supposed to do? Probably double tap him. I can't be sure he's alone, I really shouldn't search the house, but I don't even know if he's armed and certainly shouldn't try to search him, so what do I do? You eliminate the threat, then exit the house, call 911, and alert the neighbors. If you have family, it is even more critical that you eliminate the threat.

If I remember correctly, a few years ago somewhere in the US a pharmacist double tapped a thief he had shot and got charged. Never heard the outcome, but it did involve the pharmacist looking for additional threats.

Exactly in what situation would a victim be expected to know it was safe to leave a threat of that nature alive?
