That's an intellectually dishonest argument if you have eyes. The stripe patterns are virtually identical. It's not just the color pattern and simply having stripes. It's the color pattern and stripping pattern being virtually identical. Lets' call a spade a spade...Houston designed those uniforms like they did on purpose to mimic the Houston Oilers.

Of course they did! But the question is whether the NFL (and a franchise in Tennessee) can prevent a university in Texas from wearing uniforms that look similar, though not identical, when those uniforms don't feature a single NFL/Oilers/Titans trademark. Only similar colors and (less) similar stripe pattern.
There also could be an argument of selective outrage. The Colts and Duke don't have "similar" uniforms. They have identical uniforms. Perhaps Duke has permission from the Colts to have that style of uniform. If not, did the NFL prosecute Duke for trademark infringement? Did they do so when Memphis copied the Bengals helmet design?
Both sides have good arguments. I just like the pettiness of the fight.
