Unfortunately today the best course of action when in a wreck that isn't your fault is to immediately get a lawyer. You know the insurance company is going to screw you over without one and you never know if the other driver will try to. It's not to "get paid" it is to be made whole. My dad refused to get a lawyer when he got hit in his work truck, a pretty new truck, it was out of commission for 6 months and has never been right. He didn't get any type of diminished value and I am pretty sure they sourced non OEM and used parts for his truck. That thing just doesn't drive right anymore, so much so I don't even like to drive it.
Get a lawyer.
