Special counsel Jack Smith on Monday urged the Supreme Court to reject Donald Trump’s “novel and sweeping” claim that he is immune from criminal prosecution on charges of conspiring to overturn the results of the 2020 presidential election.

“The President’s constitutional duty to take care that the laws be faithfully executed does not entail a general right to violate them,” Smith said in his office’s main brief to the justices before the Supreme Court reviews the case on April 25, the final day of the court’s oral argument calendar for this term.

Trump’s D.C. prosecution for allegedly trying to block Joe Biden’s victory is on hold while the justices consider his immunity claim, and the high court’s ruling will determine whether and how quickly Trump faces trial.

The justices’ decision to take up Trump’s claim — rather than let stand an appeals court decision that he can be prosecuted — has drawn criticism for delaying the trial, which initially was scheduled to begin in early March.

Trump, the presumptive 2024 Republican nominee for president, has tried to push the D.C. trial and the other legal challenges he faces until after the general election rematch with Biden. If Trump is again elected president, he could appoint an attorney general who would seek to have the federal cases dropped.

Maybe he should talk with Mr. Hur about this concept.

I don't have to entertain the merits of Jack Smith's arguments because the premise that this is a legitimate prosecution is false.

This is the same cabal that has jailed Peter Navarro. It has no credibility.

The president is Jack's boss. Obviously, we do not want to leave prosecutions of presidents in the hands of people who report to the president.

This is why the impeachment process exists.

I wonder what Special Council Smiths thoughts are on Bidens refusal to uphold existing federal laws regarding immigration? Not only has Biden refused to follow the law, he directs his departments to actively work against those laws.

All without a peep from the media or the DOJ.

He should he hung by his balls for treason.

Can a sitting President order the military to arrest the SC Justices along with the opposing party’s nominee for President and hold them in Cuba indefinitely while ignoring all current laws?

A guy using novel prosecution techniques (and slapped down before by SCOTUS for it) is asking for someone else’s novel argument to be ruled against.

What a piece of shite this guy is.

Questioning a corrupt presidential election is not just something Killery and other Dems can do, but Trump can do it too....

If the USSC can't see this they are pretty stupid
