A 1983 action is brought against governments who violate the plaintiff’s constitutional rights.

George Floyd’s family brought one, for example.

(Alleged) Police brutality is not the only way that a state actor can violate your civil rights. Because James “state” as opposed to local Gvt official - he’d have to walk a fine line, bc there are certain legal impediments for state officials, but there are exceptions.

Abuse of process and malicious prosecution are also torts - even without a 1983 claim, and in fact, 1983 doesn’t apply to this type of claim.

He could ultimately sue her for abuse of process - bc she really filed the lawsuit to get elected and to get Biden fake elected. He doesn’t need a jury to exonerate him to bring that one - he could file it the minute that crap judgment got reversed on appeal, or even before.
