I don't define it. The law does. Juries are only fact finders. This thread is about what the jury decides, therefore the discussion is limited to factual issues.

Trump's ability to declassify documents is not decided legal by a jury.

The whataboutism argument is also, theoretically, a legal issue and not decided by a jury.

If the prosecution engaged in improper behavior, the effects on the case would be a legal decision, and the jury would only, at most, possibly be able to consider it as a credibility issue (again, if the judge permits).
