The settlement agreement wasn't money to repair the roof. The settlement agreement got our legal fees back, but it was for the builder to hire an independent, licensed roofing contractor to repair the roof, at the builder's sole cost, within a certain time - all of which was done. The builder just didn't pay the roofers apparently (the roof was fixed last October) - and we are now getting notice of the lawsuit recently filed.

Got it.. I should have read slower.. Hope it works out for you. Contractors are the worst!!

I'm not an attorney, but if you have proof all that was already adjudicated along with signed paperwork by you and the original builder, I don't think you'll be liable.

Although, as others have said, homeowners bear the brunt of shady contractors all the time so who knows.

In Louisiana, I'm pretty sure that the time period for filing a lien is expired. I worked for a wholesale building materials distributor and we would strictly observe the time limits stated in the law and file a lien against the property. Filing a lien and notifying the property owner was most times enough to get payment.

DO NOT allow the roofing company to do anymore work on the roof. If they step foot on that roof to fix a leak, nail on a loose shingle, etc., it could restart the clock concerning the time limits.
