Cops arrest. DA charges. I don't know for sure but his arrest for attempted murder might not have even been run by the DA at the time.

And yes, often times cops will charge everyone within spitting distance to the "crime" knowing the DA can wheel and deal. If the least bit of probable cause, albeit in the shallow mind of some local yokul, they can and do arrest.

Say what you want it to be, I'm saying what happens from time to time.

I would imagine this will go to a grand jury and we'll see from there.
