He can be drunk as cooter brown. That isn’t a crime
But helping his buddy get the boat back in the trailer and leave the scene is 100% a crime
He should never be allowed to be a state trooper after that. Doesn’t make him an awful human? No, but it should exclude you from being an officer

Which is why he wasn’t charged.
