If this is put in front of a Progressive judge, the law doesn't matter at all.

Not even required in Louisiana. Reach through the window or make any attempt to gain entry via door or breaking glass is all that's needed. Local shooting here went down like that, road rager started hitting the glass and took room temp challenge seriously.
