I don't know how anyone can look at the Dems prosecution of Trump starting prior to inauguration and believe its fair on any scale.
I'm no Trump fan but I try to be objective, he was fricked from the start by activism.

Also, you would lose this argument, bigly. I imagine the incarceration rates of Democrats is probably 50:1 compared to Republicans.
If there's a 2-tier justice system, it targets Democrats. You don't want to go down that road.
But that wasn't my argument. You're talking about 50-75+ different jurisdictions and prosecuting agencies and millions of participants over thousands of riots. You're not going to make a simple black and white distinction in the 2 concepts.
