The clause was created to deal with the insurrection of the Civil War and still exists today.
What these lawyers are saying is one can be barred from holding office if some official decides that person was part of insurrection.
Raffensperger, for example, could simply say based on his experiences with Trump surrounding the 2020 election he has deemed him unworthy under this clause of appearing on the Georgia 2024 ballot.
quote:
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

And what I’m saying is that anyone who believes that is an idiot. Completely absurd interpretation that fails every possible measurement of constitutionality and due process.
They’re academians smelling their own farts and dreaming up Never Trump fantasy

Ok so the SOS of Alabama could say based on his experiences Biden is not the legitimate president therefore he deems him unworthy based on the insurrection that took place Nov. 3rd. Stupid argument. Flat out idiotic.
