Not a lawyer, but slept in a Holiday Inn Express last year.
It's my understanding that this would be a Federal Violation of Labor "Laws" much like missed 401k payments/matches. This is assuming that they withheld funds to pay for insurance but did not pay. If insurance is 100% company(BTR), they still might have a leg to stand on but probably not two feet. The employees could raise tee-total-hell if it was a private business. However, being BTR GOV "who cares?", not the authorities.

A private entity failing to remit employee 401k and HSA withholdings would be fined to the extent that few would be able to survive. Feds do NOT mess around when it comes to this type of behavior.
