sure they can as the NIL deals are not tied to a player playing for a specific school. However, it would be bad business for a company/NIL entity to pay a player based on a verbal commitment.
i.e. per LHSAA rules, Arch Manning could sign an NIL deal with Nike tomorrow. Regardless if he goes to UT or somewhere else.

I'm sure its illegal for one of the contract clauses to say:
"In exchange for X dollars, you will do the following:
- attend X university"
But could someone get creative and say:
"In exchange for X dollars, you will do the following:
- live in the city of X where company X is located"
"In exchange for X dollars, you will do the following:
- attend X university"
But could someone get creative and say:
"In exchange for X dollars, you will do the following:
- live in the city of X where company X is located"
