While your second example is valid, is the driver of the boat not a dumbass for letting minors stand where they shouldn't while in motion? He may have been a dumbass sober as well, but poor choices on his behalf.

Right they aren't quite the same. But got me thinking about it b/c neither was really the driver's fault.
